General Terms and Conditions (GTC)

These General Terms and Conditions ("GTC") set out the terms and conditions governing the use of the webshop operated at www.riflescopeshop.com by Miseta Zsolt e.v. (registered address: 1032 Budapest, Szőlő u. 84. 4/22; tax number: 69387412-1-41), acting as the service provider ("Service Provider"). Please use our services only if you agree with all provisions herein and consider them binding upon yourself. This document is not filed, is concluded in electronic form only (and does not constitute a written contract), and makes no reference to any code of conduct.

Please read this document carefully before finalising your order, as by completing your order you accept the contents of these GTC.


Definitions

Parties: the Seller and the Buyer collectively

Consumer: a natural person acting outside the scope of their profession, independent occupation, or business activity

Consumer Contract: a contract to which at least one party is a consumer

Website: this website (www.riflescopeshop.com), which serves as the platform for concluding contracts

Contract: a sales contract concluded between the Seller and the Buyer via the Website and electronic correspondence

Means of distance communication: any means enabling the parties to make contractual declarations in each other's absence for the purpose of concluding a contract; including in particular unaddressed or addressed printed matter, standard letters, press advertisements with order forms, catalogues, telephone, fax, and devices providing internet access

Distance contract: a consumer contract concluded within the framework of a distance sales system organised for the supply of goods or services under the contract, whereby the parties are not simultaneously physically present and use exclusively means of distance communication for the purpose of concluding the contract

Product: any tangible movable property available on the Website that is offered for sale and constitutes the subject matter of the Contract

Business: a person acting within the scope of their profession, independent occupation, or business activity

Buyer / You: the person making a purchase offer and concluding a contract through the Website

Warranty: In contracts concluded between a consumer and a business (hereinafter: consumer contract), within the meaning of the Civil Code:

  • a contractual guarantee voluntarily undertaken by the business beyond its statutory obligations, or in the absence of such obligations, for the proper performance of the contract; and
  • mandatory statutory warranty

General Provisions

1.1. Matters not regulated by these GTC, and the interpretation of these GTC, shall be governed by Hungarian law, with particular reference to Act V of 2013 on the Civil Code ("Civil Code") and Act CVIII of 2001 on certain issues of electronic commerce services and information society services. The mandatory provisions of applicable legislation apply to both parties without any separate agreement.

1.2. This contract is valid from 1 January 2021 for an indefinite period and applies to commercial services provided through the www.riflescopeshop.com website.

1.3. The www.riflescopeshop.com website is protected by copyright. All content appearing on the website may be used, in part or in full, solely to the extent necessary for using the website. Any other use — including printing, reproduction, public disclosure, distribution, or other commercial activity — requires the prior written consent of Miseta Zsolt e.v.

1.4. The website is available 24 hours a day; however, enquiries from users can only be answered on working days between 8:00 AM and 5:00 PM.

Products and Services Available for Purchase

1.6. Products available on the website may only be purchased online via www.riflescopeshop.com. Prices shown next to products are gross prices and do not include shipping or packaging costs.

1.7. The Service Provider provides a detailed name and description for each product and displays product photographs. Images shown on product pages may differ from the actual product and may in some cases serve as illustrations only.

1.8. If a promotional price is introduced, the Service Provider will fully inform users of the duration of the promotion.


Ordering Process

1.9. Registration is not required to make a purchase on the website. Before adding products to the cart, please select whether you wish to pay in EUR or HUF — it is advisable to choose whichever currency is more economical for you. Products can be added to the cart in the desired quantity using the "Add to Cart" button on the product page. The contents of your cart can be reviewed on the "Cart" page accessible from the navigation menu, where quantities can be adjusted, items can be removed, and the total amount and estimated shipping cost can be checked. Once all settings in the cart are correct, clicking "Proceed to Checkout" will take you to the checkout page, where you can enter your billing and shipping details and select your preferred payment, delivery, and collection method.

1.10. The selected product(s) can be paid for by bank card at the time of ordering, by advance bank transfer after placing the order, or by cash on delivery upon receipt. The price displayed next to each product is the gross purchase price, payable in either EUR or HUF. If bank transfer is selected, the ordered product will be reserved for the Buyer for a maximum of 3 working days. If payment is not received within this period, the order will be cancelled and the reserved product will be released. Orders placed electronically will be delivered by GLS or DPD courier service.

1.11. The webshop is obliged to confirm receipt of the order to the customer electronically without delay. If this confirmation does not reach the customer within the expected timeframe given the nature of the service — but no later than 48 hours from the time the order was sent — the customer is released from any obligation to maintain their offer or from any contractual commitment. An order and its confirmation are deemed to have been received by the Service Provider and the customer respectively at the time they become accessible to the respective party. The parties may derogate from the above rules by mutual agreement.


Procedure in the Event of Incorrect Pricing

1.12. A price shall be considered manifestly incorrect in the following cases: a price of 0 (zero) HUF; or a discounted price where the discount is stated incorrectly (e.g. a product priced at HUF 1,000 being offered at HUF 500 with a stated discount of 20%). In the event of an incorrect price being displayed, the Seller will offer the Buyer the opportunity to purchase the product at the correct price; upon receiving this information, the Buyer may decide whether to place the order at the correct price or to cancel the order without any adverse legal consequences.


Order Processing and Fulfilment

1.13. Receipt of the order is acknowledged by the system via an automated reply. Order processing takes place on working days between 8:00 AM and 5:00 PM — after payment confirmation in the case of card or bank transfer payments, or upon receipt of the order in the case of cash-on-delivery orders. In-stock items are packed in order of receipt, and orders received by 11:00 AM are handed over to the courier on the following working day morning. If a different schedule applies, the Buyer will be notified by email.

1.14. For in-stock items, the standard fulfilment period is 3–6 working days from confirmation. For items that are incoming or on order, the standard fulfilment period is 3–6 weeks from confirmation. If no delivery date has been agreed between the Service Provider and the User, the Service Provider is obliged to fulfil the contract by the date or within the period specified in a demand from the User, or — in the absence of such a demand — no later than 30 days from the receipt of the order by the Service Provider.

1.15. If the Service Provider is unable to fulfil its contractual obligations because the specified product is unavailable, it must notify the User without delay and indicate the expected delivery timeframe. If the User accepts the new delivery date, the contract remains in force. If the new date is not acceptable to the Buyer, the Service Provider must refund the amount paid by the Buyer without delay, but no later than within thirty days.

Right of Withdrawal

1.16. In accordance with Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses, the User may withdraw from the contract without giving any reason within 14 days of receiving the ordered product and return it.

1.17. The right of withdrawal may be exercised only if the product is returned to the Seller within 14 days in its original factory packaging, complete, undamaged, free from signs of use, and accompanied by the invoice. The Buyer is obliged to notify the Seller of the withdrawal, preferably in writing, by email or letter.

1.18. The Seller shall refund the full purchase price promptly upon return of the goods, but no later than within thirty days. The refund does not cover the cost of return shipping, which is borne entirely by the Buyer. The Seller is only obliged to accept returns of goods that are undamaged and free from signs of use.

1.19. The Seller is entitled to deduct from the refund an amount corresponding to the depreciation in value resulting from use or improper use of the product. If the product is returned showing signs of use, it shall be considered second-hand and a maximum of two-thirds of its price will be refunded.


Guarantee and Warranty

1.20. The Buyer is obliged to inspect the product as soon as possible after receipt to check for any damage sustained during shipping. Any such damage must be reported to the Seller via the provided contact details. The Buyer is required to return the defective item to the Seller in its original packaging together with the invoice. The cost of returning a defective item is borne by the Buyer.

1.21. Our products are covered by the manufacturer's warranty. In the event of a defect, please contact us by email at szerviz@riflescopeshop.com. In your message, please describe the fault, how it occurred, and on what type of firearm the scope was used.

1.22. The warranty is only valid when presented together with the original invoice. Any authorised service centre listed in the warranty document can provide guidance in person or by phone on the steps to take; we are also available via our contact details for further assistance.


Grounds for Voiding the Warranty

1.23. The product has been damaged due to improper use.

1.24. The product has been used beyond the manufacturer's specified performance parameters, has been damaged through use on a firearm with a mechanical fault, or has been used on a spring-powered airgun that has not been correctly reduced to 7.5 joules.

1.25. Repair or attempted repair by a non-authorised service centre.


Complaint Handling

1.26. If a warranty issue arises, please notify us without delay at szerviz@riflescopeshop.com. We will respond within 2 working days and advise you on the next steps.


Miscellaneous

1.27. The Service Provider assumes that Buyers and Users of the Website have basic knowledge of browsing and using websites. Accordingly, the Service Provider bears no liability for any damage resulting from technical errors or improper use of the website.


General Clauses

1.28. The Service Provider and the User shall endeavour to resolve any disputes amicably. For any disputes arising under these GTC that cannot be resolved by agreement within 30 (thirty) calendar days, the parties submit to the jurisdiction of the Pest County District Court / Regional Court.
